Terms and condition



1. Introduction and Acceptance

Welcome to YallaGo Delivery. These Terms and Conditions (hereinafter "Terms") govern the access and use of our mobile application and website in Tunisia. By accessing the YallaGo platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

YallaGo Delivery acts as a technological intermediary connecting three parties:

  1. Users (Customers) who place orders.

  2. Restaurant Partners who prepare orders.

  3. Delivery Partners who deliver the orders.

 

2. Terms for Users (Customers)

 

2.1. User Account: You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login details. A valid Tunisian phone number is required. 2.2. Orders:

  • Any confirmed order obligates the User to pay the total amount.

  • Cancellation is only possible if the restaurant has not yet started preparation ("In Kitchen"). Once preparation has begun, no refunds will be issued. 2.3. Pricing and Payment:

  • Prices are displayed in Tunisian Dinar (TND), including all taxes (TTC).

  • Fees: The total price includes item price + delivery fee + service fee (if applicable).

  • Payment Methods: We accept Cash on Delivery (COD) and electronic payments (National/International Bank Cards).

  • If "Cash on Delivery" is selected, the customer agrees to be present at the delivery address and pay the exact amount to the courier. Unjustified refusal to pay will result in account suspension.

 

3. Terms for Restaurant Partners (Vendors)

 

3.1. Hygiene Standards: The Restaurant guarantees that all products are prepared in compliance with current food safety and hygiene standards in Tunisia (ONSSA). 3.2. Availability: The Restaurant agrees to update its menu in real-time on the app (out of stock items, exceptional closures). 3.3. Preparation: The Restaurant agrees to adhere to the indicated preparation times to avoid delaying the Delivery Partner. 3.4. Packaging: The Restaurant is solely responsible for packaging food adequately to withstand transport (motorbike/scooter).

 

4. Terms for Delivery Partners (Independent Couriers)

 

4.1. Status: The Delivery Partner acts as an independent contractor (freelancer) and not as an employee of YallaGo Delivery. 4.2. Documentation: The Delivery Partner must possess a valid driver's license, vehicle insurance, and a clean criminal record. 4.3. Traffic Laws: The Delivery Partner agrees to strictly adhere to the Tunisian Highway Code. YallaGo assumes no liability for traffic violations or accidents. 4.4. Conduct: Opening, consuming, or tampering with order contents is strictly prohibited. Theft or inappropriate behavior will result in immediate termination of the partnership.

 

5. Liability and Limitations

 

5.1. Intermediary Role: YallaGo is neither a restaurant nor a transportation company. We are a connecting platform. We are not liable for the quality of the food (Restaurant's responsibility) or delays caused by traffic (Force Majeure). 5.2. Force Majeure: YallaGo is not liable for delays or cancellations due to unforeseeable events (strikes, severe weather, national internet outages).

 

6. Data Protection (Privacy)

 

In compliance with Tunisian legislation on personal data protection, YallaGo is committed to protecting your information. Your data (address, phone number) is shared with the Courier and Restaurant solely for the purpose of fulfilling the order.

 

7. Governing Law and Jurisdiction

 

These terms are governed by the laws of the Republic of Tunisia. In the event of a dispute not resolved amicably, the competent courts shall be those of YallaGo Delivery's headquarters (or the courts of Tunis).
